General Terms and Conditions of Sale

PREAMBLE

These general terms and conditions govern the relationship between, on the one hand, Romane Quillet, with SIRET number 889 885 786 00018, owner of the website www.gazedparis.com, whose registered office is located at 75014 Paris, France, hereinafter referred to as "Gazed," and, on the other hand, the person who makes a purchase remotely via the company’s website Gazed https://www.gazedparis.com, hereinafter referred to as "the Customer."

The Parties agree that orders placed with Gazed via the Internet are governed exclusively by these general terms and conditions of sale, to the exclusion of any other conditions available on the website https://www.gazedparis.com.

GENERAL PROVISIONS

The website https://www.gazedparis.com has been designed by Romane Quillet, who is the owner and holder of all related rights. Unless prior written consent is obtained from Gazed, it is prohibited to copy or download all or part of the Site or its content.

The products offered on the website are described in product sheets, some of which include a photo and specify their name, colour, and characteristics. The photographs and images illustrating the website and product descriptions do not form part of the contract. Photos and images on the site are not contractual, and the merchant's liability cannot be engaged in any case.

ARTICLE 1 • PRICES

1.1 – The prices of the products are indicated in euros, inclusive of taxes, excluding shipping costs.

Amounts expressed in other currencies are provided for information purposes only.

1.2 – All orders, regardless of their origin, must be paid in euros.

1.3 – Gazed reserves the right to change its prices at any time. Products will be invoiced based on the prices in effect at the time of order confirmation by Gazed, as outlined in Article 3-2 of these general terms and conditions.

1.4 – VAT Exemption

1.4.1 For deliveries outside the European Union (including Switzerland), VAT exemption applies according to Article 262-I-1 of the French General Tax Code (CGI).

1.4.2 For deliveries within France under VAT exemption, the exemption applies according to Article 275 of the CGI.

1.4.3 For intra-community deliveries under VAT exemption, the exemption applies according to Article 265-ter-1 of the CGI.

1.4.4 For orders within France, VAT exemption applies according to Article 293B of the CGI.

ARTICLE 2 • ORDER

2.1 – The Customer declares that they have read and accepted these general terms and conditions before placing the order.

2.2 – The order must be placed on the website: https://www.gazedparis.com.

2.3 – Both parties acknowledge that the products presented on the website https://www.gazedparis.com may no longer be available or may no longer be for sale at the time of the order.

2.4 – When entering data in the "my cart" section, the Customer must ensure the accuracy and completeness of the mandatory data provided. Any subsequent modifications must be mentioned as soon as possible.

2.5 – Only individuals legally capable of entering into contracts concerning the goods and services offered on the site may place orders on https://www.gazedparis.com.

2.6 – Gazed reserves the right to suspend or close the account of a customer who violates these general terms and conditions. Any person whose account has been suspended or closed will not be able to place orders on the www.gazedparis.com website without prior authorization from Romane Quillet.

ARTICLE 3 • ORDER VALIDATION

3.1 – The order is deemed accepted by Gazed if the payment is received by Gazed within a maximum of 8 days after the order.

Gazed will then confirm the acceptance of the order to the user, at their discretion, by one of the following means: email (summarizing the order: products, price, quantity...), phone, or post. This confirmation, or, if applicable, the refusal to accept an order, will be confirmed to the user no later than 48 business hours after receiving the order and payment (unless certain cases are specified on the site).

3.2 – The sales contract for the product will be concluded when the Customer, after having had the opportunity to check the details of their order and total price, as well as to correct any errors, confirms it to Gazed to express their final acceptance.

3.3 – Any order confirmed by the Customer constitutes the conclusion of the sales contract and, consequently, acceptance of the prices, descriptions, and quantities of the products available for sale, as well as the clauses in these general terms and conditions.

3.4 – The data recorded and stored by Gazed constitutes proof of all transactions between Gazed and its customers.

ARTICLE 4 • DELIVERY

4.1 – Gazed strives to ensure delivery within 5 to 18 working days for France, and 5-21 working days for other destinations, starting from the receipt of the order and payment (see delivery rates and times). The indicated times are average usual times and correspond to processing and delivery times.

4.2 – Gazed commits to informing the Customer of any foreseeable delay in delivery.

4.3 – The shipping times indicated on the website are for informational purposes only and are not binding. The shipping date is the date on which Gazed hands the package to the carrier. Gazed commits to delivering the product within 15 working days from the order. In case of unavailability of the ordered product, Gazed will inform the customer by any means. In this case, the customer may request a refund if the merchant is unable to provide the customer with an equivalent product. Gazed commits to refunding the customer within thirty days from the receipt of the request.

4.4 – Delivery times provided by Gazed to the Customer vary by country. They are indicated for information purposes on the website https://www.gazedparis.com, and Gazed cannot be held responsible for any delays beyond the indicated times when the order is confirmed. However, Article L114-1 of the French Consumer Code allows the customer to cancel their order if the delivery time exceeds 7 days. The customer must do so by registered letter with acknowledgment of receipt.

4.5 – Gazed will not be responsible for any delivery delay due to the Customer's absence at the time of delivery or incorrect information provided by the Customer to Gazed. Products are delivered to the address indicated when ordering.

4.6 If Gazed incurs additional shipping costs due to an incorrect delivery address, wrong recipient, or failure to deliver the goods, these costs will be charged to the Customer.

4.7 – If the recipient or a person to receive the Products is absent at the time of delivery, the carrier will leave a delivery notice at the address provided by the Customer, inviting the Customer to pick up the Products.

4.8 – Ownership of the goods and associated risks transfer to the customer once the products are in the Customer’s possession.

4.9 – The Customer can only issue reservations during delivery if the delivery does not match the order quantity.

4.10 – Any reservation must be notified to the carrier at the time of delivery. A copy of the reservation must be sent to Gazed (by email or fax) no later than 12 hours after the reservation has been made. It is the Customer’s responsibility to provide Gazed with confirmation from the carrier regarding the validity of the reservations.

4.11 – In the event of non-compliance of the products with the order, the Customer must send Gazed a letter or email of dispute. Gazed will then either exchange or adjust the product(s). The request must be made within seven (7) working days of delivery. Claims made after this period will not be accepted. Products must be returned to Gazed in the same condition as when the Customer received them. Return shipping costs will be borne by the Customer.

4.12 – The Customer agrees to settle or ensure the payment of any customs duties, VAT, or other taxes due upon the import of the Products into the delivery country.

 

ARTICLE 5 • PAYMENT

5.1. – Payment is made online via the following payment methods (Carte Bleue, Visa, Eurocard/Mastercard/ American Express/ApplePay, and PayPal) at the time of order confirmation by the Customer.

5.2. The request for authorisation to debit the card is made at the time of order confirmation on the website www.gazedparis.com, except in cases of server unavailability. Gazed reserves the right to make a new request for authorisation if the initial request could not be processed due to server unavailability.

5.3. In the event of payment failure, an incorrect address, or any other issue with the Customer’s account, Gazed reserves the right to block the Customer’s order until the issue is resolved.

In the case of fraudulent use of their credit card on the website www.gazedparis.com, the Customer is invited to contact Gazed by email at gazedparis@gmail.com.

5.4. Gazed implements all necessary measures to ensure the confidentiality and security of bank details transmitted on the Site. The Site is equipped with a secure payment system that encrypts your bank details. Payment information is transmitted according to the highest security standards. The transmission of your bank details is secured by our partner: Stripe. Stripe is not registered in France.

All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted, or used by third parties. At no time do the Customer’s financial data pass through Gazed’s computer system. Stripe verifies that the connection with the Customer’s browser is secure before sending the payment form to the financial institution that processes the transaction.

Since Stripe is a technical service provider, it does not handle disputes related to orders, which are managed directly by customer service, as specified above, or by the Customer's bank if applicable.


ARTICLE 6 • RETURNS POLICY FOR NON-CONFORMING PRODUCTS

6.1. The Customer must verify the conformity of the Products received in fulfilment of their order at the time of delivery. Any issues regarding delivery, such as:

  • Damaged parcel,
  • Missing products,
  • Damaged products,
  • Products not conforming to the order,

must be reported within the legal deadlines following the receipt of the order.

This notification must be sent to the customer service of the Gazed website:

By email to gazedparis@gmail.com.

After this period, and unless a hidden defect is found, no claims will be accepted by Gazed, and the Products will be deemed conforming.

6.2. For any return of a non-conforming Product, the Customer must follow the procedure below:

6.2.1. The Customer must inform Gazed customer service by sending an email to gazedparis@gmail.com requesting a return for non-conformity.

Once the Customer receives a response authorising the return, they must complete the return form provided in the package, including their name, order number, and details of the items to be returned.

6.2.2. No return will be accepted without the aforementioned return authorisation, duly completed.

The Products must be returned in their original packaging, with their labels and any accessories, in the same condition as the Customer received the Products, to the following address:

The risks and return costs are the sole responsibility of the Customer.

6.2.3. When non-conformity has been established, Gazed will offer the Customer either:

  • The replacement or repair of the Product(s) at Gazed’s expense, or
  • A refund of the order price (product price and shipping costs) as well as the return shipping costs for the non-conforming product, no later than 14 days from the date of notification of the non-conformity confirmation by the customer service of the website www.gazedparis.com.

In the event of a refund, Gazed will refund the full price of the returned products, as well as the shipping costs, excluding taxes and customs duties paid by the Customer upon delivery.

Gazed will cover the return postal costs based on the tariff scale (standard Colissimo delivery without tracking) displayed by La Poste on March 1 of the current year. The Customer must provide proof of the return shipping costs incurred to the Customer Service by email.

6.2.4. In case of abnormal or abusive claims, Gazed reserves the right to refuse any future orders.

6.3. For international orders subject to customs duties, the Customer agrees to pay any customs fees upon receipt of the parcel. If the Customer fails to pay the customs fees and the parcel is returned to Gazed, the shipping and return costs will not be refunded.


ARTICLE 7 • RIGHT OF WITHDRAWAL/RETURNS

7.1. The Customer has a period of thirty (30) working days from the date of receipt of their order to return the Products ordered, without justification or penalty.

7.2. For any return within the scope of the right of withdrawal, the following procedure must be fully followed:

7.2.1. The Customer must inform Gazed customer service by sending an email to gazedparis@gmail.com informing Gazed of the Customer’s intention to return the product(s) and also specifying the reason for the return.

Once the Customer receives a response authorising the return, they must complete the return form provided in the package, including their name, order number, and details of the items to be returned.

7.2.2. No return will be accepted without the duly completed return form.

The Products must be returned in their original packaging, with their labels and any accessories, in perfect condition for resale:

7.2.3. The risks and return costs are the sole responsibility of the Customer.

7.2.4. Subject to the conditions mentioned above, Gazed will refund the Customer the total amount of the order (product price and delivery costs) excluding return costs. The Customer's bank account will be credited with the amount within fourteen (14) days from the receipt of the Products by Gazed.

ARTICLE 8 • WARRANTY / LIABILITY / FORCE MAJEURE

8.1. – Gazed’s liability cannot be engaged in the event of stock shortages, delivery delays, strikes (including transport strikes), or force majeure, and more generally, for any event that is not exclusively and directly attributable to it.

8.2. – The photographs illustrating the products on the website www.gazedparis.com are not contractual (colour may vary depending on lighting, and size may appear differently depending on the model's size).

8.3. – The Customer accesses, uses, and navigates the Gazed website at their own risk.

8.4. – Gazed has an obligation of means for all stages of access to the site, the ordering process, delivery, or subsequent services. Gazed cannot be held liable for any inconvenience or damage inherent in the use of the internet network, including service disruptions, external intrusion, or the presence of computer viruses. Neither Gazed nor the Customer can be held liable for any non-performance originating from any act of force majeure, beyond its control, including, but not limited to, and in accordance with case law, situations such as war, riots, insurrection, transport interruptions, import or export problems, strikes, lock-outs, shortages, fires, earthquakes, storms, floods, etc.

8.5. – The Customer acknowledges and accepts that, to the extent permitted by applicable regulations, Gazed cannot be held liable for direct, indirect, incidental, or moral damage, costs, losses, loss of revenue or profits, or liabilities of any kind (even if the occurrence of such damage was known or could have been foreseen by https://www.gazedparis.com), arising from the use or inability to use the site or its content.


ARTICLE 9 • COOKIES

9.1. In order to process the Customer's order and to better understand their needs and personalise the services offered on the Site, Gazed uses cookies. A cookie is a computer file stored on the Customer's hard drive, intended to signal their visit to the Site.

9.2. Cookies store the Customer’s identity (known via their email address and password) and the content of their shopping basket for the duration of their visit to the Site. Once disconnected from the Site, this information is stored for 30 (thirty) days before being permanently deleted.

9.3. The Customer can oppose the recording of cookies by configuring their internet browser. However, doing so will result in the loss of personalisation of the service offered on the Site.

ARTICLE 11 • APPLICABLE LAW – DISPUTES

This contract is governed by French law. The language of this contract is French. In the event of a dispute with professionals and/or traders, the courts of Paris shall have jurisdiction. In case of a dispute, French courts shall be exclusively competent.


ARTICLE 12 • PERSONAL DATA

Gazed is committed to protecting the personal data provided by the Customer. All personal data concerning the Customer collected by Gazed is handled with the strictest confidentiality, in accordance with the provisions of Gazed’s personal data protection policy.


ARTICLE 13 • MEDIATION

Consumer Service Recourse: In the event of a disagreement or dispute concerning a service or product related to the company, the consumer Customer can submit a motivated complaint to our customer service:

Recourse to the Mediator: Starting from 1st January 2016, if, after exhausting the recourse options with our consumer service, a misunderstanding or disagreement persists between us and provided the conditions for admissibility set out in the Consumer Code are met, you may address the free Consumer Mediator we are subject to, who will attempt to bring the parties together to reach an amicable solution:
